PERSONAL DATA

3 COLLECTION OF PERSONAL DATA WHEN VISITING OUR WEBSITE

If you use the website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you would like to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security. The legal basis for this is Art. 6 Para. 1 f GDPR:

IP ​​address: In order to access Bom Pastor Lda. web pages, the short-term registration of the IP number is essential. The IP address is the globally valid, unique identifier of a computer and consists of four blocks of numbers separated by dots. As a private user, you will usually not use a constant IP address, as your provider only assigns it to you temporarily for one session. 4 CONTACTING US BY E-MAIL OR CONTACT FORM

When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, if applicable your name and your telephone number) will be stored by us in order to answer your questions. If we request input via our contact form that is not required to contact you, we have marked it as optional. This information is used to specify your request and to improve the processing of your request. This information is provided expressly on a voluntary basis and with your consent, Art. 6 Para. 1 a GDPR. If this information relates to communication channels (e.g. e-mail address, telephone number), you also consent to us contacting you via this communication channel if necessary to answer your request. We delete the data collected in this context after storage is no longer required or restrict processing if there are statutory retention periods.

5 NEWSLETTER

5.1 GENERAL INFORMATION

With your consent in accordance with Art. 6 Para. 1 a GDPR, you can subscribe to our newsletter, with which we inform you about our work on environmental protection. We use the so-called double opt-in procedure to register for our newsletter. This means that after you register, we will send you an email to the email address you provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration, your information will be deleted.

Mandatory information for sending the newsletter is:

  • First name

  • Last name

  • Email

After you confirm, we will save your email address for the purpose of sending the newsletter. The legal basis is Art. 6 Para. 1 a GDPR.
You can revoke your consent to receive the newsletter at any time and unsubscribe from the newsletter. You can revoke your consent by clicking on the link provided in each newsletter email or by sending a request to christian@bom-pastor.com.
The data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected. Your email address will therefore be stored as long as your newsletter subscription is active.

5.2 NEWSLETTER TRACKING

We would like to point out that we evaluate your user behavior when sending the newsletter. We record whether the newsletter has been opened. Embedded links contain UTM parameters.

 

  • The UTM parameters enable us to add trackable extensions to your URLs. The parameters are:

    • medium: This parameter describes the medium in which the link is embedded. Examples: email, social media or website

    • source: With this UTM parameter we define the source of the link. This can be newsletters, websites, apps or social media channels
    • campaign: This type of UTM parameter is used to identify the actual campaigns. For example, if we send you a newsletter every month, the individual newsletters can be evaluated separately
    • term: Keywords so that the link can be better identified
    • content: Within a campaign, we insert various elements to be tracked in order to clearly identify them and evaluate them separately. Examples: button, image or video

The data is only collected pseudonymously.

7 WEBSITE ANALYSIS

For the purposes of analyzing and optimizing our websites, we use Matomo, which is explained below. This allows us to analyze, for example, how many users visit our site, which information is most in demand, or how users find the offer. Among other things, we collect data about which website a data subject came to a website from (so-called referrer), which subpages of the website were accessed, or how often and for how long a subpage was viewed. This helps us to make our website user-friendly and to improve it. The data collected in this way is not used to personally identify individual users. Anonymous or at most pseudonymous data is collected. The legal basis for this is Art. 6 Para. 1 f GDPR.

7.1 USE OF MATOMO

This website uses the open source web analysis service Matomo. Matomo uses so-called "cookies." These are text files that are stored on your computer and enable an analysis of your use of the website. For this purpose, the information generated by the cookie about the use of this website is stored on our server. The IP address is masked according to the 192.168.xxx.xxx scheme. The information generated by the cookie about the use of this website will not be passed on to third parties. You can prevent cookies from being saved by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. If you do not agree to the storage and use of your data, you can deactivate the storage and use here. In this case, an opt-out cookie will be stored in your browser that prevents Matomo from saving usage data. If you delete your cookies, this will also result in the Matomo opt-out cookie being deleted. The opt-out must be reactivated when you visit our site again.

7.2 USE OF GOOGLE MAPS

We use Google Maps, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). Google Maps is used to integrate map material into our website, for example to display our location. If you access a website on our website that includes Google Maps, a connection is established to a Google server and your IP address is transmitted in order to display the map and may be stored there. Depending on the device used and the approved app permissions, your location and user data may also be transmitted. The server location may be in the USA. The legal basis for the use of Google Maps is our legitimate interest in optimizing our online offering, Art. 6 Para. 1 lit. f GDPR. 8 ONLINE SERVICES (NEWSLETTER, tree sponsorship and supporter FORM)

If you register for one of our personalized online services, for example, if you subscribe to an online newsletter or donate online, we will ask you for your name and other personal information that we need for this purpose. The legal basis for this data processing is your consent, Art. 6 Para. 1 lit a GDPR. Under no circumstances will we use your personal data for other purposes without your consent. The data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected and there are no statutory retention periods that prevent it.

As a general rule, your data is sent to us in encrypted form to prevent access by unauthorized third parties. If you donate online, we may also save the so-called banner ID. This is part of the URL that you see in the address bar of your browser. This makes it possible to record how you found the donation or petition page (e.g. via an advertising banner on another website or a banner on the Bom Pastor Lda website). The legal basis for this data processing is our legitimate interest in evaluating and improving our online campaigns, Art. 6 Para. 1 lit.f GDPR.

We store your data on specially protected servers. Access is only possible for a few specially authorized persons, all of whom are familiar with the relevant data protection regulations.

9 ADVERTISING

9.1 GOOGLE TAG MANAGER

We use Google Tag Manager, a service provided by Google LLC. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Tag Manager itself does not collect any personal data. Tag Manager makes it easier for us to integrate and manage our tags. Tags are small code elements that are used, among other things, to measure traffic and visitor behavior, record the impact of online advertising and social channels, set up remarketing and targeting, and test and optimize websites. If you have deactivated personalized advertising by Google, this deactivation will be taken into account by Google Tag Manager. 9.2 DOUBLECLICK BY GOOGLE

We use DoubleClick, a service provided by Google LLC. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). The service is integrated via YouTube. DoubleClick uses cookies to display user-based advertisements. The use of DoubleClick cookies enables Google and its partner websites to display advertisements based on previous visits to our or other websites on the Internet. The cookies recognize which advertisement has already been displayed in your browser and whether you have accessed a website via an advertisement. Affected persons are all users of our online offering. The legal basis for the use of Google DoubleClick is our legitimate interest in optimizing our online offering and promoting our association's purposes, Art. 6 Para. 1 lit. f GDPR.

If you do not want to receive user-based advertising, you can deactivate the display of advertisements using Google's ad settings. You can find more information about which types of cookies and how Google uses cookies in Google's privacy policy and under "Types of cookies used by Google".

9.3 GOOGLE ADWORDS AND CONVERSION TRACKING

In order to draw attention to our current projects and developments, planned activities or truly environmentally friendly products and services, we place Google AdWords ads and use Google Conversion Tracking as part of this. These ads are displayed after search queries on websites in the Google advertising network. We have the option of combining our ads with certain search terms. We also use AdWords remarketing lists for search ads. This enables us to adapt search ad campaigns for users who have already visited our website. The services give us the option of combining our ads with certain search terms or of placing ads for previous visitors that, for example, advertise services that visitors have viewed on our website.

An analysis of online user behavior is necessary for interest-based offers. Google uses cookies to carry out this analysis. When you click on an ad or visit our website, Google places a cookie on the user's computer. This information is used to be able to target the visitor in a later search query.

Further information on the cookie technology used can also be found in Google's information on website statistics and in the privacy policy.

With the help of this technology, Google and we as the customer receive information that a user has clicked on an ad and was redirected to our websites. The information obtained in this way is used exclusively for statistical analysis for ad optimization. We do not receive any information that can be used to personally identify visitors. Your IP address is transmitted to Google, but since we use Google's IP masking on this website as part of the use of Google Analytics, your IP address is anonymized. The statistics provided to us by Google include the total number of users who have clicked on one of our ads and, if applicable, whether they were redirected to a page on our website with a conversion tag. Using these statistics, we can understand which search terms were clicked on our ad particularly often and which ads lead to the user contacting us via the contact form.

If you do not want this, you can prevent the storage of the cookies required for these technologies, for example, via the settings in your browser. In this case, your visit will not be included in the user statistics.

You also have the option of selecting the types of Google ads or deactivating interest-based ads on Google via the ad settings. Alternatively, you can deactivate the use of cookies by third parties by calling up the Network Advertising Initiative's deactivation tool.

However, we and Google continue to receive statistical information on how many users visited this site and when. If you do not want to be included in these statistics either, you can prevent this with the help of additional programs for your browser (e.g. with the Ghostery add-on).

9.4 GOOGLE DYNAMIC REMARKETING

On our website we use the dynamic remarketing function of Google AdWords, a service of Google LLC. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). The technology enables us to display automatically created, target group-oriented advertising after you visit our website. The ads are based on the online engagement options we offer that you clicked on the last time you visited our website. These can be online petitions or donation forms.

Google uses cookies to create interest-based ads. Cookies are small text files that are stored in your browser when you visit our website. Google usually stores information such as your web request, IP address, browser type, browser language, date and time of your request. This information is only used to assign the web browser to a specific computer. It is not used to identify a person.

For remarketing, we only use data that we have already collected using Google Analytics. For this purpose, we create target groups based on the Google Analytics data already collected. The aim is to be able to target users who have completed certain steps on the website again. For this purpose, advertisements are then provided for the defined target groups in the Google Display Network. The existing Google Analytics pixel is used to collect the data, and all data required for the evaluation is stored in a cookie. Since data is collected via Google Analytics, all data collected is pseudonymized. It is not possible for us to draw conclusions about individual people.

If you do not want to receive user-based advertising from Google, you can deactivate the display of advertisements using Google's ad settings or, alternatively, select the types of Google ads. You can also prevent the storage of the cookies required for this technology by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. 9.5 FACEBOOK CUSTOM AUDIENCES / FACEBOOK PIXEL

As part of an ad campaign to support our petitions on Facebook, we use the Custom Audiences service from Facebook Inc. (1601 S. California Avenue, Palo Alto, CA 94304, USA) as part of usage-based online advertising. For this purpose, we use the Facebook Ads Manager to define target groups of users based on certain characteristics, who are then shown ads within the social network. Users are selected by Facebook based on the profile information they provide and other data provided through the use of Facebook. If a user clicks on an ad and then goes to our website, Facebook receives information via the Facebook pixel integrated into our website as to whether the user has effectively participated in our petition or not.

Basically, a non-reversible and non-personal checksum (hash value) is generated from your usage data, which is transmitted to Facebook for analysis and marketing purposes. A Facebook cookie is set. This collects information about your activities on our website (e.g. surfing behavior, subpages visited, etc.). Your IP address is also stored and used to geographically target advertising. After submitting the petition or protest form, the user is given the opportunity to confirm participation by clicking on a link (email notification) as part of the double opt-in process. This page view by the user is registered by Facebook via the Facebook pixel. In this case, the user is subsequently shown a "Become a Supporter" ad in the social network. If the confirmation link is not clicked, the user is subsequently shown a "Please confirm" ad on Facebook. We do not use Facebook Custom Audiences via the customer list, nor the "extended matching" function.

Further information about the purpose and scope of data collection and the further processing and use of the data by Facebook, as well as your setting options for protecting your privacy, can be found in Facebook's privacy policy. You can make settings for which advertisements are shown to you on Facebook using this link and in the Facebook account settings.

The transfer of data to the USA is permitted under Art. 45 GDPR, as Facebook is Privacy Shield certified and therefore an appropriate level of data protection exists according to Commission Implementing Decision (EU) 2016/1250 (http://eur-lex.europa.eu/legal-content/DE/TXT/HTML/?uri=CELEX:32016D1250...). The legal basis for the data processing described is a legitimate interest in accordance with Art. 6 Para. 1 Clause 1 f GDPR, namely the promotion of our association's purposes and targeted advertising of campaigns and petitions.

9.6 NEW RELIC

New Relic, a performance analysis service provided by New Relic Inc. (101 Second Street, 15th Floor, San Francisco, CA 94105), is integrated into this website via the Stackla service. New Relic uses cookies to collect data on user behavior on our website. This information is then used to create and save user profiles using pseudonyms. The pseudonymized user profiles are not merged with the website user's personal data without the express consent of the person concerned. In addition, we use New Relic to measure and monitor the technical performance of our website, i.e., for example, to determine whether the website can be accessed and how quickly the respective page is displayed. To do this, New Relic collects data about this website, such as system data on add-ons used, usage times, browsers used, hardware and software used (so-called "application data"). 10 DATA TRANSFER

Your data will not be transferred to third parties except in the cases mentioned above, unless we are legally obliged to do so, or the data transfer is necessary to carry out a contractual relationship or you have previously expressly consented to the transfer of your data.

External service providers and partner companies such as online payment providers or the shipping company commissioned with the delivery will only receive your data if this is necessary to process your order. In these cases, however, the scope of the data transferred is limited to the minimum required. If our external service providers come into contact with your personal data, we ensure that they comply with the provisions of the data protection laws in the same way as part of the order processing in accordance with Art. 28 GDPR. Please also note the respective data protection notices of the providers. The respective service provider is responsible for the content of third-party services, whereby we check the services for compliance with the legal requirements as far as reasonable.

We attach great importance to processing your data within the EU / EEA. However, it may happen that we use service providers who process data outside the EU/EEA. 1 DATA SECURITY AND DATA MANAGEMENT

Bom Pastor Lda. collects personal data from online activists and donors that is required for the purposes of fundraising and donation management as well as for the preparation and implementation of online activities.

We only use your address details, and with your consent, your telephone number and email address, for sponsor services and information. The data is only transmitted to associated Bom Pastor Lda. in order to inform you about current developments, planned activities or environmentally friendly products and services and only on the basis of your prior consent. You can revoke your consent in this regard at any time.

If it is clear from the context of data collection that data is not absolutely necessary and is therefore not marked as mandatory data, such information is voluntary.

We assure you that we do not sell or rent your data to other companies or organizations in the general address trade. Of course, you have the right to stop access to information to you at any time and to object to the use of your communication data for this purpose. To do so, write to christian@bom-pastor.com.

In order to fulfil our tasks and ensure the security of our IT infrastructure, we must work with service providers who may also receive personal data for this purpose. These service providers are contractually bound by Bom Pastor Lda. and may only use personal data that they receive in this context for the permitted purpose (see above, section 13).
